Limits of Liability
Limited Liability: NIUD shall not be liable for any incidental, consequential, or indirect damages, including but not limited to loss of profits, revenue, data, or use, incurred by the user or any third party, arising out of or in connection with the use or inability to use our products.
Exclusion of Damages: NIUD shall not be liable for any damages, including but not limited to personal injury, property damage, or any other loss or harm, regardless of the cause, arising out of or related to the use, misuse, improper application, or modification of our products by the user or any third party. This exclusion applies to all claims, whether based on warranty, contract, tort, or any other legal theory, and regardless of whether NIUD has been advised of the possibility of such damages.
Product Replacement: NIUD's liability is strictly limited to the replacement cost of the product. In no event shall NIUD's total liability exceed the original purchase price of the product. This remedy is exclusive and in lieu of all other remedies, whether oral or written, express or implied.
Warranty Disclaimer: To the fullest extent permitted by applicable law, NIUD disclaims all warranties, whether express or implied, with respect to the product. This disclaimer includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The products are provided on an "as is" and "as available" basis without any warranty whatsoever.
Applicable Law: This limitation of liability shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from the use of NIUD’s products shall be resolved exclusively in the courts of Malaysia.
Consumer Rights: This limitation of liability does not affect your statutory rights as a consumer. If any part of this limitation is found to be unenforceable, the remaining provisions shall remain in full force and effect.
